1. Acceptance of Terms
By accessing or creating an account on Kairos ("the Service") provided by Kairos Studia ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Eligibility
You must be at least 16 years old to register and use the Service. By using the Service, you represent that all information provided is accurate and complete. If using the Service on behalf of a photography studio or business entity, you represent that you have legal authority to bind that entity to these Terms.
3. Photographer Accounts & Gallery Access
Account & Subdomain Credentials
You are responsible for maintaining the security of your account credentials and custom studio URL / subdomain. All activities occurring under your photographer workspace are your responsibility.
Gallery PIN & Access Authorization
You retain full control over client gallery access settings, including 4-digit PIN protection, visitor registration requirements, and download permissions. You and your authorized clients are responsible for safeguarding PIN credentials.
Watermarking & Asset Protection
Custom PNG watermarking features are provided as a digital safeguard. While Kairos applies watermarks dynamically based on your settings, you acknowledge that no digital display is immune to unauthorized screen recording or capturing.
4. Acceptable Use Policy
You agree to use the Service solely for lawful photography studio operations and client proofing. You must NOT:
- Upload or share content that is illegal, defamatory, obscene, or infringes third-party copyrights or privacy rights
- Upload media for which you do not possess copyright or valid licensing authorization
- Attempt to bypass storage quotas, collection limits, or system access controls
- Use automated scripts, bots, or scrapers to extract high-res assets or metadata from the Service
- Distribute malware, malicious links, or unauthorized promotional spam through client galleries
- Interfere with or disrupt the stability, security, or performance of Cloudflare R2 storage or platform servers
5. Intellectual Property & Copyright Ownership
100% Photographer Copyright Ownership
You retain 100% copyright, trademark, and intellectual property ownership of all photos, videos, and media files uploaded to Kairos Studia. We claim zero ownership over your creative work.
Limited Operational License
By uploading content, you grant Kairos Studia a strictly limited, non-exclusive, royalty-free license solely to host, process, watermark, and display your media as necessary to operate the Service for you and your clients.
Our Platform Rights
The Kairos Studia brand, logo, code, interface designs, and infrastructure are the exclusive property of Kairos Studia. You may not copy, reverse engineer, or create derivative works of the platform.
6. Subscriptions, Storage Quotas & Razorpay Billing
Subscription Tiers & Razorpay Gateway
Subscription plans (Free, Starter, Pro, Business) are billed via Razorpay. By subscribing, you authorize recurring billing to your selected payment method (Credit/Debit Card, Netbanking, or UPI).
Storage Limits & Quotas
Each subscription plan includes a designated Cloudflare R2 storage quota (e.g. Free Tier 2GB, Pro Tier 100GB). Exceeding active collection or storage limits will require upgrading your plan to upload additional high-res photos.
Cancellation Policy
You can cancel auto-renewal at any time via your billing dashboard. Cancellation takes effect at the end of the current paid billing cycle, during which your premium features remain fully active.
Refund Policy
Subscription fees are non-refundable except where required by applicable consumer protection laws or in cases of proven billing errors reported within 30 days.
7. Account Termination & Data Export
We reserve the right to suspend or terminate accounts that violate our Acceptable Use Policy. You may close your account at any time. Upon account deletion, all stored photos and client data will be permanently purged from Cloudflare R2 storage within 30 days.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." KAIROS STUDIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT ACCESS WILL BE UNINTERRUPTED, FULLY UNFAILING, OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAIROS STUDIA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR CLIENT GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO KAIROS STUDIA IN THE PRECEDING TWELVE (12) MONTHS.
10. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any legal dispute or claim arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
11. Changes to Terms
We may update these Terms from time to time. Registered users will be notified 7 days prior to material updates via email or account notifications.
